Election: Electronic transmission of results is not mandatory for INEC as per Section 60 – APC

The All Progressives Congress (APC) Presidential Campaign Council (PCC) says there is no law requiring the Independent Electoral Commission for Elections to transmit election results electronically.

PCC Special Adviser on Media and Communications Mr. Dele Alec made the announcement in Abuja on Friday when he spoke at a press conference.

Alec said transmission of election results was at the discretion of the Independent Electoral Commission, as per Article 60, Subsection 2 of the Elections Law.

According to him, the 2022 Elections Law does not include any mandatory clause regarding the transfer of results.

He said, “The grievance against the electronic transmission of election results is not supported by the law.

“Section 38 of the 2022 Election Act that the People’s Democratic Party (PDP) and Labor Party (LP) relied on to challenge the result of the February 25 presidential election has nothing to do with the transmission of election results.

Section 60, subsection 2 of the Act deals with the transmission of results and is at the discretion of the Independent National Electoral Commission. The Act does not contain any mandatory provision in relation to the transmission of results.

“In any case, the process of transmitting results from polling units, whether in real time or after two days or at any time, can in no way change the results that have been announced,” Alec stressed.

He added that the important thing is to count the votes in the presence of party agents and to hear the voters.

Alake said it was ridiculous to imply that the time difference in loading the results would cause a change in the numbers.

“In any case, the process of transmitting results from polling units, whether in real time or after two days or at any time, can in no way change the results that have been announced,” he said.

He added that the press conference was to respond to each of the candidates of the People’s Democratic Party, Alhaji Atiko Abu Bakr and MP Peter Obi, after their recent statements regarding the election results.

He described the efforts by the People’s Democratic Party, the Liberal Labor Party and the Palestinian National Congress Party to communicate with the court about the election results as a welcome development.
